{"id":41009,"date":"2025-04-08T16:16:03","date_gmt":"2025-04-08T16:16:03","guid":{"rendered":"https:\/\/www.premium-partners.net\/?p=41009"},"modified":"2025-04-09T05:14:36","modified_gmt":"2025-04-09T05:14:36","slug":"network-providers-raise-concerns-over-icasas-satellite-licensing-framework","status":"publish","type":"post","link":"https:\/\/www.premium-partners.net\/fr\/builder\/network-providers-raise-concerns-over-icasas-satellite-licensing-framework\/","title":{"rendered":"Network providers raise concerns over Icasa&#8217;s satellite licensing framework"},"content":{"rendered":"<p>This <a target='_blank' rel=\"nofollow\" href=\"https:\/\/www.iol.co.za\/business-report\/economy\/network-providers-raise-concerns-over-icasas-satellite-licensing-framework-130f38d8-0598-4406-a698-7e5eae579ca6\">post<\/a> was originally published on <a target='_blank' rel=\"nofollow\" href=\"https:\/\/www.iol.co.za\/\">this site<\/a><\/p><p><img decoding=\"async\" src=\"https:\/\/image-prod.iol.co.za\/16x9\/800?source=https:\/\/iol-prod.appspot.com\/image\/a59492a31f1c109fd8e100f3e67e8e8d3633d97b\/2000&amp;operation=CROP&amp;offset=0x61&amp;resize=2000x1125\" class=\"type:primaryImage\" \/><\/p>\n<p><span>The Association of Communications &amp; Technology (ACT) &#8211; representing leading network operators including MTN, Vodacom, Telkom, and Rain &#8211; has publicly expressed its deep concerns regarding the Independent Communications Authority of South Africa&#8217;s (Icasa) recently proposed satellite services licensing framework.<\/span><\/p>\n<p><span>After three days of hearings, Icasa aims to establish what it describes as an \u201cinformed and inclusive approach to the framework for satellite service for satellite services in South Africa\u201d.<\/span><\/p>\n<p><span>However, ACT CEO Nomvuyiso Batyi on Tuesday said <\/span><span> all licensees in the sector, not just new satellite entrants, deserved a more considered regime. <\/span><\/p>\n<p><span>\u201cIt also believes that any attempt by Icasa to develop a satellite licensing framework with the hope of achieving universal broadband connectivity will be doomed to failure unless it <\/span><b>first<\/b><span> repairs the broken framework for universal service and access to communications,\u201d she said.<\/span><\/p>\n<p><span>Batyi said they were also concerned that Icasa\u2019s proposed satellite services licensing framework was being developed within the constraints of an outdated legislative environment\u2014specifically, <\/span><span>Chapter 3 of the Electronic Communications Act (ECA).<\/span><\/p>\n<p>She said if Icasa<span> intended to modernise the licensing regime, it should consider a holistic review of the entire licensing framework rather than a piecemeal approach that singles out satellite services. <\/span><\/p>\n<p><span>\u201cThis chapter defines licensing categories in sections 5 and 6, which have historically been used to license satellite networks and services,\u201d Batyi said.<\/span><\/p>\n<p><span>\u201cRevisiting the framework comprehensively would ensure coherence, consistency, and fairness across all service categories, ultimately aligning the regulatory environment with technological advancements and global best practice.\u201d<\/span><\/p>\n<p><span>Batyi added that a lack of harmonised rules could allow satellite operators to bypass critical responsibilities such as compliance with service quality standards and consumer protection regulations. <\/span><\/p>\n<p><span>She said that without harmonised rules that ensure a level playing field, network operators, terrestrial and satellite networks cannot complement each other effectively. <\/span><\/p>\n<p><span>\u201cThis risks undermining South Africa\u2019s broader goal of achieving universal broadband access. The sector requires substantial infrastructure investment to meet the needs of <\/span><b>next-generation<\/b><span> networks. Regulatory ambiguity or perceived imbalance may deter such investment, particularly for long-term, capital-intensive projects that are essential for expanding and modernising connectivity,\u201d she said.<\/span><\/p>\n<p><span>Batyi also called for robust evolution of the legislative framework.<\/span><\/p>\n<p><span>\u201cThe ECA was enacted nearly 20 years ago and is increasingly misaligned with the realities of today\u2019s fast-changing digital and technology-driven environment. ACT supports a modernised, fit-for-purpose legislative framework that is agile, inclusive, and resilient,\u201d she said.<\/span><\/p>\n<p><span>\u201cIt should be adaptive to new technologies, outcomes-based in its approach, and developed through collaborative stakeholder engagement.
